What is Conveyancing?
Conveyancing is the legal process of transferring the title of a property from one person to another. It can also include granting a lien or mortgage on the property.
Conveyancing involves the following steps:
- Exchange of contracts: Both parties sign a contract of sale, keeping one copy each.
- Completion: Also known as settlement, this is when the legal title passes to the buyer. The buyer receives the keys to the property.
A conveyancer or conveyancing solicitor can help with the conveyancing process. They can:
- Have the contract signed on behalf of the buyer
- Notify financial institutions when payments are made
The conveyancing process involves a number of documents, including: Deed, Mortgage documents, Certificate of liens, Title insurance binder, and Side agreements.
The conveyancing process also includes searches to confirm the property's condition, boundaries, and layout.
There are many types of conveyancing, including deeds used for different types of real estate transactions, as well as voluntary conveyances:
- Sale deed: The most common type of conveyance deed, used to transfer ownership and confirm payment during a property sale and purchase
- Gift deed: Used to legally transfer property as a gift without monetary exchange
- Exchange deed: Used when two parties agree to exchange ownership of their properties
- Settlement deed: Used to transfer property as part of a family settlement, such as when dividing ancestral property
- Lease deed: Used to grant leasehold rights to a property for a set rental period, while the lessor retains ownership
- Mortgage deed: Used to transfer property to a lender as security for a loan
- Partition deed: Used to divide property among co-owners, such as when inheriting or owning property jointly
- Relinquishment deed: Used when a co-owner voluntarily gives up their share of a property, often to another co-owner
- Public grant: Used to transfer publicly-owned land to a private individual
- Private grant: Used to transfer privately-held land to an individual
- Public dedication: Used to transfer privately-held land to the government or a government-operated organization
A conveyance deed is a document that shows that two or more parties have transferred a title or deed between them. It can be used as evidence if there is an issue regarding ownership
